Laborers’ District Council COBRA Continuation Coverage Refund Policy
This COBRA Refund Policy governs requests for refunds made through the Laborers’ District Council COBRA Continuation Coverage Online Portal (“the Portal”). This policy is intended to ensure fair, consistent, and timely handling of overpayments or other eligible refund scenarios in accordance with applicable laws and regulations, including the Consolidated Omnibus Budget Reconciliation Act (COBRA).
Refunds may be issued in the following circumstances:
- Overpayment of premiums
- Duplicate premium payments
- Payment made for a period after a COBRA termination date
- Fund Office administrative error
- Payment made for a participant or beneficiary who is not COBRA eligible
Refunds may NOT be issued in the following circumstances:
- Voluntary discontinuation of COBRA coverage
- Late payments
To request a refund, participants must complete a Refund Request Form on the Portal.
Refund requests must be submitted within 10 days of the date on which the error occurred. Requests made after this period may be denied, unless approved at discretion of the Fund Administrator.
Refund requests are typically reviewed within 30 days of the Fund Office’s receipt. Approved refunds will be issued within 30 days of approval. Refunds will be returned via original payment method.
If a refund request is denied, the participant may submit a written appeal within 30 days of the denial notice date.
Participants are encouraged to retain proof of all payments and communications. Refunds may be subject to offset against other outstanding COBRA balances.
